The Problem with Hourly Billing in Family Court

Hourly billing creates a situation where the more complicated your case gets, the more you pay, and you never quite know where the ceiling is.

Here is how it typically goes. You pay an upfront retainer, often $3,000 to $5,000 or more. Your lawyer bills against that retainer at their hourly rate. When the retainer runs out, you get a bill and a request to replenish it. If your case drags on, or if the other side is difficult, those bills keep coming.

The problems with this model in Family Court are real:

  • Every court appearance costs you. Each time your lawyer shows up, you are paying for their travel time, wait time, and appearance time.
  • Every phone call costs you. Questions about your case, updates on scheduling, anything involving your lawyer's time gets billed.
  • Delays cost you. Family Court cases get adjourned. Judges have packed dockets. The other side causes delays. Every one of those adjournments means more billable hours.
  • You have no way to budget. You cannot plan financially when you do not know what your legal bill will be next month.

What a True Flat Fee Means (And What It Does Not)

When I take a custody case on a flat fee basis, here is what that covers:

  • All court appearances, however many there are
  • All filings with the court
  • Preparation for hearings
  • Communication with the other side
  • My time in court fighting for you

What a flat fee typically does not include are out-of-pocket expenses like filing fees, service of process costs, or fees for expert witnesses if your case requires them. Those are pass-through costs, not legal fees, and I will always be upfront about what they are before they come up.

I built my practice this way because I believe clients should be able to focus on their case, not their bill. When you are not watching the clock every time you call me, you are more likely to ask questions, stay informed, and make better decisions. That is good for you and it is good for your case.

Custody and Visitation Pricing

For child custody and visitation matters, my flat fee is $5,000 for the pre-trial phase and $5,000 for trial if your case goes that far.

The pre-trial phase covers everything from your first filing through hearings, negotiations, and any appearances before a judge or court attorney-referee. If we resolve your case before trial, the pre-trial fee is all you pay.

If your case needs to go to trial, the trial fee covers full preparation and all trial appearances. Most lawyers who bill hourly will see their fees climb well past this number by the time a custody trial is done.

Payment Plans Are Available

I understand that coming up with a lump sum is not realistic for every family. Payment plans are available. Call me and we will figure out something that works.
