CPS involvement is not something you can wing. It is not a situation where showing up and explaining your side of things will make it go away. Once child protective services is involved, especially once a case reaches Suffolk County Family Court, you are dealing with a legal process that has real consequences for your family. The wrong move early on can follow you for years.

I am Steven Zalewski. I have spent my entire career in Suffolk County Family Court, and neglect and abuse cases are some of the most serious matters I handle. What Happens When CPS Files a Case in Suffolk County Family Court?

The Petition and First Appearance

Once a neglect or abuse petition is filed, it is assigned to Suffolk County Family Court in Central Islip or Riverhead. You will receive notice of a court date, and that first appearance happens fast, sometimes within days. At that initial hearing, a judge may issue temporary orders that could include supervised visitation, restrictions on where your children can be, or in serious cases, removal of your children from the home.

What happens at that first appearance sets the tone for everything that follows. Showing up without a lawyer, or showing up unprepared, puts you at an immediate disadvantage.

What the Court Is Being Asked to Decide

The petition spells out what DSS is alleging and what they are asking the court to do. That can range from ordering supervision services to seeking removal of your children. The court will ultimately decide whether neglect or abuse occurred and what, if anything, should happen as a result. That process can take months and involve multiple appearances, hearings, and potentially a full trial.

What Are the Possible Outcomes in a Suffolk County CPS Case?

Not every CPS case ends the same way. Depending on the facts, the evidence, and how the case is handled, outcomes can include:

  • Dismissal of the petition entirely
  • Adjournment in Contemplation of Dismissal (ACD), where the case is put on hold and dismissed if you meet certain conditions
  • A finding of neglect or abuse, which goes on your record and can affect custody, employment, housing, and professional licensing
  • A supervision order, requiring you to comply with services for a set period
  • Removal of your children and placement with DSS or a relative

Do You Have a Right to a Lawyer in a CPS Case?

Yes. Under New York law, parents have the right to counsel in Article 10 proceedings. If you cannot afford an attorney, the court will assign one to you through the 18-B assigned counsel program.

Assigned Counsel vs. Hiring Your Own Attorney

Assigned counsel are real lawyers, but they are also handling a large volume of cases simultaneously. The reality of the system is that an overloaded attorney may not have the time to dig into the details of your situation the way a private attorney can. You may meet your assigned lawyer for the first time in the hallway outside the courtroom.

  • Signing service plans or agreements without understanding what they mean. Agreeing to services can sometimes be used as an acknowledgment that a problem exists.
  • Missing court dates. Even one missed appearance can result in a default order against you.
  • Assuming the case will resolve on its own. It will not. These cases require active, engaged representation.
  • Using AI-generated documents or online legal templates. This is a serious mistake. AI tools do not know your case, your court, or New York Family Court law. Documents generated this way can hurt more than they help.
  • Waiting too long to hire an attorney. The first court date matters. If you wait until after that appearance to get a lawyer, you may already be behind.
